These Terms of Service (“Terms”) govern your access to our website (automotiveart.us) and your use of Automotive Art’s estimates, repairs, calibrations, pick-up/delivery, and related services (“Services”). By using our website or Services, you agree to these Terms.

1) Who may use the Services

You must be at least 18 and able to form a binding contract. You agree to provide accurate information and keep it current.

2) Estimates, approvals & supplements

• Estimates are good-faith, non-binding assessments based on visible damage. Hidden damage may require supplements and can change price and repair time.

• By signing a repair order (digital or paper), you authorize us to perform repairs, sublet specialized operations if needed, road-test your vehicle, and operate/store it on public/private roads.

• If insurance is involved, you authorize us to communicate with your insurer/adjuster and share necessary information and photos/videos.

3) Insurance, deductibles & “zero out-of-pocket”

Where insurance coverage applies, your insurer typically pays covered charges, and you remain responsible for any deductibles, non-covered items, upgrades, or betterment. Any “zero out-of-pocket” promotion applies only when insurer payments fully cover allowed charges and deductibles have been waived or otherwise satisfied. Promotions may be modified or discontinued at any time and are subject to eligibility and applicable law.

4) Parts, materials & calibration

We may use OEM, aftermarket, remanufactured, or recycled parts consistent with insurer requirements and availability, unless otherwise agreed in writing. We perform ADAS calibration in-house when applicable and feasible; certain procedures may require sublet or dealer programming.

5) Turnaround & storage

Estimated completion dates are not guarantees. We are not responsible for delays outside our control (e.g., parts backorders, insurer approvals, weather). 

6) Pick-up, delivery & towing

Where offered, pick-up/delivery/towing is provided as a convenience and may be subject to availability, distance, weather, and safety conditions. You are responsible for removing personal items from the vehicle. We are not liable for loss of aftermarket devices or items left in the vehicle.

7) Payment & lien

Payment is due upon completion unless otherwise agreed. We may accept insurer payments on your behalf. You grant us a possessory lien on the vehicle for unpaid charges, permitted by law. Unpaid balances may be referred to collections.

8) Warranties

Any warranty will be stated in your written estimate/repair order. Unless a written warranty is provided, Services are delivered “as is” to the fullest extent permitted by law. This section does not limit any non-waivable consumer rights.

9) Photos, testimonials & reviews

You grant us a non-exclusive right to use before/after photos of the repair (without showing license plates or personal info) for quality, insurer documentation, and only with your consent for marketing. You are responsible for any content you submit (e.g., reviews) and you agree we may display it consistent with our Privacy Policy.

10) Website use & intellectual property

All site content (logos, text, graphics) is owned by Automotive Art or its licensors and protected by law. You may not copy, modify, or distribute site content except for personal, non-commercial use. Do not misuse the site (e.g., introduce malware, scrape, or attempt unauthorized access).

11) Disclaimers & limitation of liability

To the maximum extent permitted by law:

• We disclaim warranties not expressly provided in writing.

• Automotive Art will not be liable for indirect, incidental, special, consequential, or punitive damages; and our total liability for claims relating to the Services will not exceed the amount you paid for the specific Service giving rise to the claim.

12) Indemnity

You agree to indemnify and hold us harmless from claims arising out of your breach of these Terms, your misuse of the Services, or your violation of law or third-party rights.

13) Electronic communications & signatures

You agree to receive documents (estimates, authorizations, invoices, updates) electronically and to sign electronically. You may withdraw consent by contacting us, which may affect our ability to provide Services.

14) Governing law & venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Dallas County, Texas.

15) Changes to the Terms

We may update these Terms from time to time. The Effective date will show the latest revision. Continued use of the website or Services after changes constitutes acceptance.
